Terms and Conditions for donations to Luma Foundation (hereinafter the “Regulations”)

1. General provisions.

1.1 The Terms and Conditions (hereinafter referred to as the “Terms and Conditions“) set out the rules for making contributions – donations to Luma Foundation (hereinafter referred to as the “Foundation“), through the website lumafoundation.eu as follows:

a) via on-line transfer – via the external payment system – Przelewy24;

b) via bank transfer made to the Foundation’s bank account no.:

1.2 Foundation – Luma Foundation with its registered office in Łaziska Górne (43-170), ul. Cieszyńska 23G, entered in the Register of associations, other social and professional organisations, foundation, and public health care facilities of the National Court Register held by District Court Katowice – Wschód in Katowice, 8th Commercial Division of the National Court Register under the KRS number 0001006054, using the statistical number REGON: 523865979 and tax identification No. NIP: 6351863942.

1.3 Purpose – contributions made via the lumafoundation.eu website will be used for the Foundation’s statutory purposes.

1.4 Website – https://lumafoundation.eu/ – maintained by Luma Foundation with its registered office in Łaziska Górne (43-170), ul. Cieszyńska 23G.

1.5 On-line payments – the Przelewy24 service is operated by the payment operator PayPro S.A. (PayPro)- an Entity providing the Service to Donors, with its registered office in Poznań, ul. Pastelowa 8 (60-198), entered in the Register of Entrepreneurs of the National Court Register kept by the District Court Poznań Nowe Miasto and Wilda, 8th Commercial Division of the National Court Register under KRS number 0000347935, tax identification No. NIP 7792369887, with a share capital of PLN 5,476,300.00, fully paid-up, and in the Register of National Payment Institutions kept by the Polish Financial Supervision Authority under number UKNF IP24/2014.

1.6 Donor – an adult natural person, a legal person or an organisational unit without legal personality.

2. Making donations.

2.1 The service provided by the Foundation electronically consists in the transfer of any amount of money in the form of a Donation by the Donor to the Foundation via the Przelewy24 – PayPro S.A. Service.

2.2 The use of the Donation Service referred to in this paragraph requires providing data in the appropriate form in the Przelewy24 – PayPro S.A. service and granting appropriate consents to use the Przelewy24 service.

2.3 Payments through the lumafoundation.pl website are secure as they are transferred to the Foundation by trusted on-line payment operators.

2.4 Contributions can be one-off.

2.5 Contributions can be made 24/7. The Foundation is not responsible for interruptions in access to the Przelewy24 – PayPro S.A. Service.

2.6 On-line donations made using payment channels of the Przelewy24 – PayPro S.A. service are non-refundable.

2.7 You can make a donation via payment channels provided by the Przelewy24 – PayPro S.A. service, i.e., by e-transfer, payment card, BLIK, and direct bank transfer.

2.8 The Foundation does not store the Donor’s credit or debit card details; these details are stored by the payment operator PayPro S.A.

2.9 When the Donor makes a consensual declaration of intent, a donation agreement is concluded, for which it is necessary, among other things, for the Donor to accept the Terms and Conditions and to fill in the relevant fields with personal data.

2.10 In the implementation of the Payment Service of the Przelewy24 – PayPro S.A. website, settlements of transactions by payment card and on-line transfer are carried out through the Settlement Centre of Przelewy24 – PayPro S.A., in accordance with the Regulations for payments at Przelewy 24 available at:
https://www.przelewy24.pl/regulamin.

2.11 The current payment regulations for payments and privacy policy of Przelewy24 – PayPro S.A. will be available during the execution of the payment.

2.12 The Foundation declares that it will not accept funds which have the appearance of being proceeds of crime.

2.13 In order to use the website and the Przelewy24 – PayPro S.A. service, a device with Internet access is required.

2.14 The Foundation is not responsible for the inadequate configuration of the Donor’s device.

2.15 The Foundation is not liable for separate service recipients: the Przelewy24 – PayPro S.A. service and its affiliates, as well as the Donor’s bank or card issuer.

2.16 The Donor has the right to request a return of the donation within 7 days of its payment. To request a return, please send an email to: office@lumafoundation.eu, with the reference: „Return of donation”. After deducting the transfer costs, the donation will be refunded within 7 business days from the date of receipt of the notification to the Foundation.

3. Personal data.

3.1 Personal data controller is Luma Foundation with its registered office in Łaziska Górne (43-170), ul. Cieszyńska 23G, entered in the Register of associations, other social and professional organisations, foundation, and public health care facilities of the National Court Register held by District Court Katowice – Wschód in Katowice, 8th Commercial Division of the National Court Register under the KRS number 0001006054, using the statistical number REGON: 523865979 and tax identification No. NIP: 6351863942.

3.2 The Foundation processes data in accordance with the Regulation (EU) 2016/679 of the European Parliament and the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/WE (Official Journal of EU L 2016, item 119) (the “GDPR”).

3.3 The legal basis for processing personal data is Article 6(1)(b), (c), and (f) of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data. This allows for data processing for the performance of a contract or pre-contractual actions at the request of the data subject, as well as in situations where the Controller is obliged to fulfil a legal obligation or has a legitimate interest – so we consider building relationships with Donors through reliable information about the progress of fund-raising and expressing gratitude, as well as storing data for the purpose of protection against claims or their enforcement.

3.4 The Foundation ensures that the personal data of Donors received from the Przelewy24 service will be processed solely for the purpose of executing the donation agreement, including banking and accounting services for donations, as well as for the legitimate interest of the Foundation, while complying with the conditions specified in the privacy policy.

4. Complaints.

4.1 Donors making payments through the Przelewy24-PayPro S.A. service can file a complaint regarding the Payment of the Przelewy24 service if the donation they provided was not executed or was executed contrary to the Cooperation Regulations with Przelewy24 available on the website at: https://www.przelewy24.pl/reklamacje.

4.2 The User’s Complaint may be submitted via email to: serwis@przelewy24.pl, or through the electronic contact form available on the website at: serwis@przelewy24.pl, or through the electronic contact form available on the website at:  https://www.przelewy24.pl/reklamacje.

4.3 Complainants can also submit their complaint in writing by mail to the address: PayPro S.A., ul.  Pastelowa 8, 60-198 Poznań, or directly at the organisational unit indicated by PayPro, where the Customer Service Office is located. Complaints submitted orally (by phone or in person) during the complainant’s visit to PayPro’s headquarters are also considered.

4.4 PayPro commits to resolving complaints within 15 business days. If additional information is required, the resolution time may be extended, but not beyond 35 business days from the date of receiving the complaint.

4.6 Regardless of the points 4.1- 4.5 mentioned above, complaints related to services provided can be submitted via email to: office@lumafoundation.eu. The Foundation will review the complaint and notify the Donor of its resolution via email within 15 (fifteen) days from the date of receiving the complaint.

4.7 In the case of complaints related to services provided by entities other than the Foundation or the Przelewy24-PayPro S.A. service, you should contact the relevant entity, such as a bank or credit card issuer.

5. Final provisions

5.1 The Foundation reserves the right to change the Terms and Conditions at any time.

5,2 By choosing to use the lumafoundation.eu website, the user accepts the provisions of these Terms and Conditions.

5.3 Matters not regulated by these Terms and Conditions are subject to generally applicable law.

5.4 These Terms and Conditions are effective from 01.02.2024.
